What's up guys,
I am sure every one of you knows Sheet Music Boss's Rush series. I, as a member of this black midi community make fan-made Rushes. Always doubt that will we be involved in any legal issues because we are copying Sheet Music Boss's Rush series.
Regarding this, I have asked a few questions about the legal issues of the Rush series. I hope this is useful to you guys.
Question 1: Do you (Sheet Music Boss) actually allow us to create our own fan-made Rushes? Or remake your Rushes?
Answer to Q1: You're welcome to remake and create your own takes on the Rush works for fun on YT. We (Sheet Music Boss) don't DMCA works that are notably different to our originals, but equally we reserve the right to take down anything that is not notably different to the work it's based on. Fair use is tricky like this.
Question 2: Can we distribute our OWN fan-made Rush midis to the public? Or sell it to earn money?
Answer to Q2: No, because you'd need to arrange licensing as it's an interpolation/recreation of an existing licensed work. If you need to do this, you can contact us (Sheet Music Boss) with details and the work and we can discuss what the best path is for legitimate licensing of your fan-made work. This is how the music publishing business works with samples, interpolations, etc.
Question 3: Can we earn revenue on YouTube using our fan-made Rush videos?
Answer to Q3: Same as Q2
Question 4: Can we apply copyright for our own fan-made Rush midi works?
Answer to Q4: It depends on what you mean by "apply copyright". Your work is your own, but you don't own the full license for any Rush interpretations - same as Q2, we (Sheet Music Boss) would need to discuss what your intentions were on a case-by-case basis.
I hope these information can helps you. Should you have any enquiries, please contact me through Discord.
